24/7 Sobriety Program Passed by South Dakota Legislature
The South Dakota legislature recently enacted a bill that establised a 24/7 statewide sobriety program (H.B. 1072) that would find and implement alternatives to incarceration for certain offenses that involve driving under the influence and other offenses involving alcohol, marijuana, or controlled substances. Some repeat offenders have already been involved in the successful two-year pilot program that led to HB 1072. In this program, repeat offenders can still drive, but they must report to designated testing areas in order to take a breath test twice a day. If the offenders fail to show up at a designated time, they will be arrested and thrown in jail. Failing a breath test also results in jail time.
