Policy Position on Support for "Move Over" Enforcement and Education

AAMVA is concerned with the safety of law enforcement officers and other emergency personnel or duly authorized roadside workers accompanying a vehicle with red, blue or amber flashing lights as they perform their duties on roadways. According to the Federal Bureau of Investigation’s Law Enforcement Officers Killed and Assaulted, every year, many law enforcement officers are victims of struck-by-vehicle incidents, i.e., at the time of their deaths they were conducting traffic stops, assisting motorists, or engaged in similar activities.

In an effort to safeguard law enforcement officers and other emergency personnel or duly authorized roadside workers whose duties require them to work in and near roadways, all states and all provinces have enacted Move Over legislation that typically requires motorists to either change lanes or slow down when approaching a law enforcement or other duly authorized response vehicle that is stopped at roadside. The effectiveness of this legislation is compromised by motorists being unaware of the existence of these statutes.

Therefore, AAMVA supports increased enforcement of Move Over legislation as well as efforts by all member agencies to increase public awareness of Move Over laws.
